Who is responsible if I am a construction worker injured by a falling object?
Tim Staines discusses the responsible party of a construction worker being hurt by a falling object.
New York Labor law section 240 doesn’t just protect workers who fall from heights. It also protects workers who are injured by objects that are being lifted/hoisted and fall onto them.
Ultimately it’s the person hoisting the object who’s responsible, but the labor law section 240 also makes the owner of the property and the general contractor responsible for the safety of the worker, so all of those parties would be responsible if an object falls.
