What Are No-Fault Benefits?
When someone’s injuries arise from use and operation of a motor vehicle, being someone who is a driver or passenger in a motor vehicle, or a pedestrian that’s struck by a motor vehicle in New York State, you’re entitled to what’s called no-fault benefits. The term ‘no-fault’ refers to the fact that that benefit occurs regardless of who’s responsible for the accident. That’s by law. So, for example, if you’re a driver of a car, the vehicle’s insurance of that particular car will pay your medical expenses and up to 80% of your lost wages. If you’re a pedestrian, the vehicle that strikes you, their insurance company will be responsible for paying medical expenses and lost wages. So, it’s a benefit that you are entitled to by operational law in circumstances when an accident involves a motor vehicle.
