New York – September 1, 2010 – The legal team from Hach & Rose, LLP, a New York law firm that represents union workers injured in construction accidents and other victims of personal injuries, recently secured a $2.5 million settlement for a New York sheet-metal worker who sustained injuries on the job when he slipped and fell on worn plywood.

The case, Baran v. Clinton Green Condo LLC (Case No, 117191/07), was on the docket in the Supreme Court of the State of New York, New York County, before Judge Doris Ling-Cohan. The parties reached a settlement just prior to the start of the trial.

The case involved a construction accident that occurred on Nov. 14, 2007. On that date, the plaintiff, a 46 year-old union-employed sheet-metal worker, was working on the roof of a building under construction at 500 W. 53rd St., in Manhattan. He slipped while he was walking on a piece of plywood and fell, sustaining serious injuries to his knee and a shoulder.

The plaintiff sued the building’s owners and the project’s general contractors, alleging that the defendants violated the New York State Labor Law.

“The plywood was used as a walkway for construction workers in order to avoid stepping on river rocks that were on the surface of the roof,” explained Michael A. Rose, partner at Hach & Rose, LLP. “This board was not secured and was worn by exposure to weather and constant wear and tear during the course of the project. One of our witnesses also testified at deposition that the board in question had been there for no less than two months prior to the accident, which indicates that the site was not properly safeguarded, as required by Labor Law.”
