Will switching attorneys cost me anything? Will it negatively impact my settlement?

Switching attorneys doesn’t impact a personal injury client’s bottom line when it comes to the resolution of their case. In New York, the legal fee in a personal injury lawsuit is one-third, whether you’re represented by one attorney or multiple attorneys. That one-third remains the same.

People often also want to know whether or not they have to pay money when they switch lawyers. The answer to that question is no as well. The procedure is that when the former attorney is replaced, they send their expenses over to the new law firm. At that point in time, we’ll review the expenses. We’ll reimburse the old law firm for all appropriate expenses, and then the file is transferred.

The client doesn’t have to speak to the former law firm if they choose not to. We can handle the transition. And if appropriate, at the end of the case, if the former law firm or law firms are entitled to compensation, that compensation comes out of that same one-third percentage.
