Dram shop liability is basically if you’re at a bar and you’re drinking, the bar owners have a responsibility to not over-serve. So, if somebody appears extremely intoxicated and they’re not cut off and they leave the bar or an incident occurs in the bar because they’re intoxicated, that would be a violation. If someone is visibly intoxicated and they continue to serve them and they get in their car and, god forbid, hit somebody or get into an accident, the bar owner or the entity that owns the bar is responsible because they over-served them and they breached their duty.
