When a person is involved in a motor vehicle accident, they can carry a policy of insurance – automobile insurance – through their household, which is greater than the automobile insurance policy carried by the person responsible for the motor vehicle accident. In those circumstances, you can make what’s called an underinsured claim against your household motor vehicle insurance policy.
When choosing an attorney to represent you in connection with the motor vehicle accident, it’s important to choose somebody who has experience in underinsured motorist claims. The reason for this is that you have to follow a certain set of rules when taking the policy of the responsible party prior to going against your own household policy of insurance. If those rules are not followed strictly, your household policy can disclaim coverage, and you will not be able to make a full recovery for your injuries.
