Daily Harvest Recall – Food Poisoning Lawsuit

Daily Harvest issued a voluntary recall of its French Lentil + Leek Crumbles products on June 23, 2022, after more than 500 customers reported falling ill with gastrointestinal symptoms that led to significantly elevated liver enzymes. In many cases, patients reported needing to have their gallbladders removed.

An investigation revealed that many affected patients had consumed Daily Harvest’s French Lentil + Leek Crumbles prior to becoming sick. Patients reported experiencing symptoms such as severe vomiting, dark urine, itching all over, stomach pain, nausea, headaches, and fever. Many of these patients are now facing steep medical bills from ER visits and hospital stays.

Daily Harvest has regularly relied on a strong network of influencers to market its products. Now, multiple influencers who became sick after consuming the French Lentil + Leek Crumbles are alleging that, due to Daily Harvest’s underwhelming response to the outbreak, they feel obligated to warn consumers about the present risks of consuming this product.

Did you become ill after consuming Daily Harvest’s French Lentil + Leek Crumbles? If so, you might be entitled to take legal action against Daily Harvest for their negligence. You could pursue compensation for medical bills, lost income, and more. Product manufacturers have a responsibility to manufacture and market products that are safe for human use and consumption. When companies fail to uphold their duty of care, they can be held liable in civil court.

Which Products Were Recalled?

All French Lentil + Leek Crumbles currently on the market have been voluntarily recalled. According to the U.S. Food and Drug Administration (FDA), approximately 28,000 units of the recalled product were distributed from April 28 to June 17, 2022, in the continental United States. Products were distributed through a variety of channels, including online sales and home delivery, as well as at a Daily Harvest retail location in Chicago, Illinois, and a pop-up shop in Los Angeles, California. Some consumers also received samples of the product.

French Lentil + Leek Crumbles are sold frozen in white, 12-ounce bags. According to the FDA, all lot codes of the product are impacted. Customers who received the product via home delivery, and other customers for whom Daily Harvest had contact details, were notified of the recall.

What Compensation Is Available?

Many individuals who consumed the affected product had to seek medical attention, with some patients having to be hospitalized. Depending on the specific circumstances of your case, you could recover compensation for:

  • Medical expenses, including ER visits, hospital bills, and doctor’s visit bills
  • Lost income, if you had to take time off work while you were being treated for your illness
  • Non-financial losses like pain and suffering

If you experienced gastrointestinal symptoms and poor liver function after consuming Daily Harvest French Lentil + Leek Crumbles, you might be entitled to seek financial relief through a product liability lawsuit. Contact Hach & Rose, LLP right away to discuss your case.

What to Do If You Become Sick Due to the Daily Harvest Outbreak

Consider taking these steps if you fall ill after consuming the affected Daily Harvest product:

  • Seek medical attention right away to protect your health and your right to pursue compensation.
  • Don’t throw the product away. Daily Harvest has told consumers with unused product to toss the product in the garbage. We recommend holding onto it and storing it in the freezer. It can be tested for pathogens, toxins, and allergens at a later date.
  • Although we recommend keeping the product, you should not eat it.
  • If you are ill, report your illness to the FDA by calling 866-300-4374 (the FDA Main Emergency Number). You can also report your illness to the Consumer Complaint Coordinator in New York by calling toll-free at 866-446-9055.
