Queens, NY – Police Continue Investigation into Fatal Pedestrian Accident

Queens, NY (January 6, 2019) – This past week, a fatal pedestrian accident took place in Queens involving an unlicensed driver and police continue their investigation into the matter.

The accident allegedly took place at 37th Avenue and 81st Street around 1 p.m. when a 43-year-old driver struck the victim who had been crossing the street at the time. The driver then drove over the pedestrian with her front right tire before she put the vehicle into reverse and drove back over the victim another time.

The pedestrian was rushed to the hospital in critical condition but, unfortunately, was pronounced dead while there. Her identity has not yet been released.

The driver was soon identified as Vitaliana Garcia Gavilan, who stayed at the scene of the accident. She is now facing charges of failure to yield, aggravated unlicensed operation, and driving with a suspended license. There was also a child in the vehicle at the time of the accident. The child is now in the care of another family member.
