Why is it important for construction workers to have an attorney on their side when they’ve been injured?

David Cheverie talks about why it is important for a construction worker to have an attorney on their side.

Well, it’s very important for numerous reasons. One, if you’re injured on the job, a lot of these companies won’t have your best interests in mind. Okay, first, a lot of things are changed on a construction site constantly. It’s important that the accident is documented properly so a company or the owner of the property doesn’t disclaim or say this accident never happened.

Insurance companies will contact you right away, they’ll try to get statements from you. They’ll pretend to be on your side and have everything in your best interests, and they don’t. They’re on the side of the company, and they’re trying to minimize their responsibility for the accident.

It’s also important than an attorney that specializes in this area is contacted right away because a lot of claims, third-party actions, are missed. Meaning, a lot of individuals that are hurt on the job think that they only have a workers’ compensation case and that’s their sole remedy. However, there are a lot of instances for construction workers through what’s called the labor law, which is a heightened protection for the construction workers, that allow them to bring what’s called a third-party claim against either the owner of the property and the GC if they work for a subcontractor if it falls within the labor law.

This deals with gravity-related injuries such as falls from a ladder, falls from a scaffold, falling objects, or code violations which are specific such as a trip or slip and fall on debris in a walkway or a pathway located on a construction site. A lot of times these claims are missed or overlooked and it’s important that you contact an attorney that specializes in the area right away. So, one, the proper steps can be taken to document the accident, whether it’s photographs, creating accident reports, getting statements of witnesses. All the evidence that needs to be collected at the beginning of a case can be crucial down the road as the case moves forward. And if you don’t get that information immediately after the accident, that information can disappear.
