New York, NY – Bus Driver Found Guilty in Death of Citi Bicyclist

New York, NY (October 1, 2018) – The charter bus driver who fatally hit an investment banker last year was found guilty today, October 1. The accident occurred in Manhattan as the victim was riding a Citi bike as part of a bike-share program. The driver was found guilty of failing to yield the right-of-way.
36-year-old Dan Hanegby, of Brooklyn, was riding the bike in the Chelsea neighborhood when the bus collided with him and knocked him off the bike. Tragically, the bus continued to run over Hanegby. Dave Lewis, the bus driver, was also found guilty of failure to exercise due care.
Lawyers for Lewis argued that Hanegby was unaware of his surroundings as he was wearing headphones at the time of the incident. However, prosecutors stated that the victim had the right-of-way and that Lewis should have been aware of the bicycle rider.
Lewis will be sentenced on October 22, for one misdemeanor and one violation, effectively facing up to 45 days in jail.
