New York law firm recovers settlement for fireman in lawsuit against the City of New York for violation of the NYC Building Code

New York – February 10, 2011 – The legal team from Hach & Rose, LLP, a New York law firm that represents union workers injured in construction accidents and other victims of personal injuries, recently secured a $2.1 million settlement for a New York City fireman who sustained injuries on the job when he slipped and fell from a ladder.

The case, Owens v. The City of New York, et al. (Case No. 39871/06), was on the docket in the Supreme Court of the State of New York, County of Kings. The parties reached the $2.1 million settlement during the trial.

The lawsuit was triggered by a construction accident that occurred on August 28, 2006. On that date, William Owens, a 60 year-old New York City fireman, was working in the boiler room of P.S. 345 in Brooklyn. He fell ten feet from a fixed ladder and became severely injured. Prior to being injured, Owens worked at the school for 36 years and the ladder had been in the same condition at the school for the same duration.

As a result of the accident, Owens is completely disabled and unable to work. The plaintiff sued the City of New York and the New York City Department of Education.

“I think this case brings to light a problem with the New York City Building Code, which does not have any regulations in place regarding fixed ladders,” explained /about/ [Michael A.
