Anti-Trust Cases

WHEN UNIONS WE WORK WITH ARE PAYING TOO MUCH FOR A PRESCRIPTION DRUG BECAUSE THE MANUFACTURER ENGAGED IN ILLEGAL ANTI-TRUST PRACTICES TO KEEP CHEAPER VERSIONS OFF THE MARKET, WE FIGHT TO END THE PRACTICE - AND TO GET ILLEGALLY GAINED PROFITS BACK IN THE HANDS OF UNIONS & THEIR MEMBERS

We consider it a privilege to be the attorneys of record for numerous organized labor unions on matters pertaining to injuries sustained by their members. In performing this function we come across and even develop new methods of recouping money for union health funds and other union trust funds which is of keen interest to the fiduciaries of such funds as well as the members they benefit.

Concerned about the High Cost of Prescription Drugs?

Large drug manufacturers sometimes do whatever they can to prevent the generic form of a retail drug from entering the marketplace. To do so without good cause violates United States Anti-Trust laws. This practice causes union members to pay higher prices for their prescription drugs. Have you been able to purchase the generic form of Neurontin? Or Cipro? Here’s an example of why:

Neurontin

We recently assisted in the filing of a class action lawsuit against PFIZER & WARNER-LAMBERT alleging that the companies initiated the filing of sham patent infringement lawsuits to prevent cheaper generic drugs from coming to marketplace. Such practices directly effect the cost to you, the consumer. Invariably, we alleged that this practice caused the union health & benefit funds, and others similarly situated, to pay a much higher price for the drug Neurontin. Michael Carney, Business Manager of IUOE Local 94 in New York City represents the class in the case to protect the monies entrusted to his union and it’s trustees by his members. The case will benefit members of IUOE Local 94 as well as health & benefit funds across the country.

Cipro

We are currently in the process of litigating a claim against BAYER AG and it’s U.S. subsidiary BAYER CORP. We allege that Bayer actually paid generic manufacturers NOT to produce the generic form of Cipro. We allege that for years, the generic form should have been available at a much cheaper price to consumers. Antitrust practices prevented that from occurring.
