Concerned about the High Cost of Prescription Drugs?
Large drug manufacturers will often take measures to prevent generic forms of a retail drug from entering the marketplace. To do so without good cause violates United States Anti-Trust laws. This practice causes union members to pay higher prices for their prescription drugs. If you have not been able to purchase the generic form of Neurontin or Cipro, we can explain why:
Neurontin
We recently assisted in the filing of a class action lawsuit against PFIZER & WARNER-LAMBERT alleging that the companies initiated the filing of sham patent infringement lawsuits to prevent cheaper generic drugs from coming to the marketplace. Such practices directly affect the cost to the consumer. Invariably, we alleged that this practice caused the union health & benefit funds, and others similarly situated, to pay a much higher price for the drug Neurontin. Michael Carney, Business Manager of IUOE Local 94 in New York City, represents the class in the case to protect the monies entrusted to his union and its trustees by his members. The case will benefit members of IUOE Local 94 as well as health & benefit funds across the country.
Cipro
We are currently in the process of litigating a claim against BAYER AG and its U.S. subsidiary, BAYER CORP. We allege that Bayer actually paid generic manufacturers to keep them from producing the generic form of Cipro. We also allege that the generic form should have been available for years, at a much cheaper price to consumers. However, Bayer’s antitrust practices prevented that from occurring.
